TERMS OF CONDITION
To use Cloudeye IT's services you must agree to the following terms and conditions:
1. Cloudeye IT reserves the right to verify and verify the necessary documents to confirm customer identity. If a person or company wants to become a customer, the signatory on his or her behalf will be obliged to provide all the documents requested by Cloudeye IT.
2.1. No customer shall use/misuse the website developed by Cloudeye IT for any purpose which is illegal, obscene, indecent, threatening, harassing, unwanted and which creates adverse national and social impact.
2.2. Customer shall be solely responsible for any such misuse after provision of the Website, which includes the use/misuse of any third party. Cloudeye IT assumes no liability.
3. Cloudeye IT reserves the right to provide all customer related information to any law enforcement agency as required by law.
4. Cloudeye IT reserves the right to suspend accounts (in the case of domains and hosting) with or without notice for breach of terms or abuse.
5.1. 50% of the agreed amount for web design as agreed between the customer and Cloudeye IT shall be paid by the customer to Cloudeye IT before the commencement of work. The work will start after this 50% advance payment. The remaining 50% will be paid by the customer within 3 days of handing over the work.
5.2. All types of content, images, information required for the website will be provided by the customer. Customer shall ensure delivery of all content required for the website within 30 days of commencement of work. If the customer fails to deliver the website content within 30 days then the website work will be considered complete and the customer will be liable to pay the remaining amount of the website design as per the contract.
5.3. The customer must accept the website within 7 days of the completion of the website and within the next 30 days, if there is any correction work on the website, it must be completed. If a customer does not accept the website within 30 days of the completion of the work, no claim that the work of the website is incomplete after the lapse of 30 days will be entertained. In this case, if the customer wants to do something extra, then the contract must be renewed.
6.1. Cloudeye IT will provide free website management services for the next 3 months after handing over the website to the customer after the completion of the website design. At this time, the customer can correct, add (included in the package according to the agreement), change, augment any information on the website if he wants.
6.2. If the customer wants to change or modify any part of the website through Cloudeye IT after the expiry of the stipulated 3 months, the customer can pay an additional fee in advance based on the agreement.
6.3. Customers can avail annual management service from Cloudeye IT at an annual charge of Rs.5000. Under this service, the customer can update the website information, update the version of the website, manage the website etc.
6.4. If the customer needs annual management service, Cloudeye IT can accept the management service under the prescribed package of the customer or can accept the management service through a new agreement based on the agreement.
7.1. In case of domain or hosting account, it must be renewed before its expiry. Failure to renew for any reason will cause the account to be actively suspended on a certain date. It will resume after paying the bill. In this case it may take 24 hours to 72 hours for the account to be reactivated.
7.2. If the expiry date has passed and the customer fails to renew within the next 7 days, the account must be renewed by paying an additional 10% late fee along with the original renewal fee.
7.3. The account can be renewed within 30 days from the specified date of expiry with and without account late fee. After 30 days the website will be automatically deleted from the server. After the expiry of 30 days no claim regarding the website of the customer shall be entertained.
8. In case of dot bd domain, the customer has to renew it before the expiry date. After expiry the customer can renew the domain later with a late fee of Rs.1000. Note that if a customer expires for more than one year, he can renew the domain with a late fee at the specified rate along with the original renewal fee for each year (Government prescribed fee).
9. Cloudeye IT reserves the sole right to increase or change the price of any of Cloudeye IT's services (including domain, hosting and web design prices). However, in this case, Cloudeye IT customer will be notified by sending a notice through the customer's registered email 2 weeks to 1 month before the effective date of the price change.
10. In case of shared hosting, the customer can use 25% of the resources (excluding disk space and bandwidth) provided for his cPanel account. If a CPanel account uses more than 25% of server resources for more than 90 seconds, that account will be marked as an overloaded account. In this case the customer has to transfer his website to suitable VPS or single server. In such circumstances 7 days prior notice will be sent to the customer and within these 7 days the customer will have to take necessary steps for his website.
11.1. Cloudeye IT shall not be obliged to refund any money to the customer if the web hosting and domain registration services are terminated due to policy violation or misuse.
11.2. The web design fee paid by the customer to Cloudeye IT is non-refundable if the customer does not wish to continue with the website for any reason. Even after paying the advance, if the customer does not want to complete the work, the advance is also negotiable.
11.3. Domain registration fees are also free in any case. However, if the hosting service is canceled within 30 days of the start of the service, the customer will get the hosting money back. Accounts suspended due to abuse will not be refunded to the customer.
11.4. Cloudeye IT provides 99% uptime guarantee for web hosting to customers. If for any reason the uptime is not provided, the customer will be provided free hosting service for the next 1 month after the customer's request. However, it should be noted that downtime due to website internal problems and server maintenance is not covered by the uptime guarantee.
12. Cloudeye IT keeps a 7-day backup of their website (up to 3GB) on a remote server to provide better customer service. However this is a third party service which is not 100% guaranteed. So every customer will download their respective website backup from cPanel and save it in a safe place. So that customer can restore his website in case of any accident.
13. Cloudeye IT shall not be responsible in any way if anyone is defrauded by Cloudeye IT's resellers or third parties using Cloudeye IT's services. To avoid fraud and harassment it is requested to contact Cloudeye IT directly for service.
14.1. If domain hosting or account ownership needs to be changed for any reason, you need to login to the Cloudeye IT panel and make a ticket in the specific section. Under no circumstances will tickets be accepted without a login or with an account that does not host that domain. Cloudeye IT may request and monitor the necessary documentation if necessary.
14.2. If for any reason the account owner forgets his account user ID, password and has no opportunity to recover it, then the owner must apply for user ID, password recovery in the prescribed form of Cloudeye IT. In this case scanned copies of relevant documents must be submitted along with the application form.
14.3. If there is a dispute between multiple persons or customers regarding the ownership or ownership of any domain, hosting or website, Cloudeye IT will reserve the right to transfer the same to the original owner after observing the necessary documents. In this case the decision rendered by Cloudeye IT will be final.
15. Cloudeye IT's interpretation/decision regarding matters mentioned in the Terms and Conditions shall be final.
